Offsetting

The Court does not have to make either a pension attachment order or a pension sharing order in every case and in many cases such an order may not be appropriate.

Offsetting is where the pension benefits are used to offset against other assets to effect a clean break settlement.

This is most often used when the pension benefits are minimal or there are specific assets you would want, such as the house, which may be offset against the ex-spouse keeping their pension benefits.
